On 20 February 2025, a draft ordinance was submitted to the Brussels Capital Parliament ‘amending the Commercial Lease Act with a view to better protecting commercial tenants, particularly in the hospitality sector’. The aim is to restore the balance between tenants and landlords, which is often lacking in practice. However, the question is whether the proposed amendments do not go too far or even miss the mark. In any case, the potentially far-reaching consequences do not seem to have been sufficiently thought through.
